The short version. We collect what we need to consider you for a driving job and to reach you about it. We do not sell your personal information. Advertising tools from Meta and Google measure how well our recruiting ads work. Applications are handled on our behalf by Tenstreet, the company behind the application form our buttons link to. Background checks on drivers happen only after you give us separate written permission, and they are required by federal regulation.
1. Who we are
This policy is issued by Lemberg Group Inc ("Lemberg", "we", "us"), a motor carrier operating under USDOT 2395323, with offices at 1141 E Main St, Unit 109, East Dundee, IL 60118.
It covers this website, lemberg4u.com, and the personal information we handle when you apply to drive for us, call or text our recruiting line, or email us.
It does not cover websites we merely link to. In particular, the application form our "Apply now" buttons open is hosted by Tenstreet, LLC at land.driverapponline.com. Once you are on that page you are also subject to Tenstreet's own privacy policy. Facebook, Instagram and Google likewise run under their own policies.
2. What we collect
Information you give us
- Contact details — your name, phone number, email address, city and state.
- Driving and work history — CDL number, class and endorsements, licence state and expiry, years of experience, previous employers and dates, accident and violation history, and anything else the application asks for.
- Eligibility information — date of birth, Social Security number and work authorisation, where these are needed to verify your record and your right to work in the United States. These are collected inside the application, not on this website.
- Anything you tell us voluntarily — what you say on the phone, in a text message or in an email.
You do not have to give us any of this. But we cannot consider you for a driving position without the information federal regulations require us to collect and verify.
Information collected automatically
- Device and connection data — IP address, browser and operating system, screen size, and the general location that an IP address implies (usually city level, not an exact address).
- Usage data — which pages you viewed, how long you stayed, what you clicked, which page or ad sent you here, and whether you clicked through to the application.
This comes from cookies and similar technologies. See section 7.
What we do not collect
We do not ask for payment card or bank details anywhere on this website. There is no payment on this site and no reason for us to request one. If you receive a message that appears to come from Lemberg and asks you to pay a fee or a deposit to get hired, it is not from us — call our office at 630-592-1235 and tell us.
3. How we use it
| What we do with it | Why |
|---|---|
| Review your application and decide whether to make you an offer | To fill driving positions, and to meet the driver qualification requirements in 49 CFR Part 391 |
| Call, text or email you about your application | Because you asked us to get in touch, and with your consent |
| Verify your licence, employment history and safety record | Required of every motor carrier by federal regulation |
| Keep your driver qualification file, drug and alcohol testing records and hours-of-service records | Required by the FMCSA and the US DOT |
| Measure which recruiting ads and pages actually produce applications | So we spend the recruiting budget where drivers actually respond |
| Keep the site working and secure, and investigate abuse | Our legitimate interest in running a functioning website |
| Answer questions and handle complaints | To respond to you |
We do not sell your personal information, and we do not share it with unrelated companies so they can market their own products to you.
4. Calls, texts and email
When you submit an application or tick the consent box on a form, you agree that Lemberg Group Inc and its recruiters may contact you by phone call, text message (SMS) and email about driving positions.
- Message and data rates may apply, depending on your mobile plan.
- Message frequency varies with the stage your application is at.
- Consent is not a condition of employment. You can withdraw it at any time and still be considered.
- To stop text messages, reply STOP to any message. To stop calls or emails, tell the recruiter, or email [email protected].
- Some calls may be recorded or monitored for training and quality. If a call is being recorded you will be told at the start of it.
Opting out of marketing messages does not stop messages that are strictly about an application already in progress, or that we are required to send you.
5. Driver background checks
Federal law requires us to check certain records before we can put a driver in a truck. These checks are separate from this website, and each one needs your specific written authorisation, which we request during the application:
- Motor Vehicle Record (MVR) from the state that issued your licence, at hire and at least once a year afterwards.
- Pre-Employment Screening Program (PSP) report from the FMCSA, covering inspection and crash history.
- Previous employer verification for the last three years, including safety performance history and any drug or alcohol testing records.
- FMCSA Drug and Alcohol Clearinghouse query, at hire and annually.
- DOT drug and alcohol testing, before employment and thereafter as required.
Some of these reports are consumer reports under the Fair Credit Reporting Act. Before we request one we will give you the disclosure and authorisation the FCRA requires. If something in a report leads us to decide against hiring you, you will receive a pre-adverse action notice with a copy of the report and a summary of your rights, and a reasonable opportunity to dispute it before the decision becomes final.
6. Who we share it with
We share personal information only with parties who need it to do a specific job for us, or where the law requires it:
- Tenstreet, LLC — hosts and processes our driver applications (the land.driverapponline.com form).
- Screening and compliance providers — the vendors that pull MVR, PSP, Clearinghouse and employment verification records, and our DOT-certified drug testing laboratories and medical review officer.
- Insurers and underwriters — when adding you to our policy requires your driving record.
- Service providers — website hosting, email, phone and SMS providers, and analytics, each acting on our instructions.
- Government agencies — the FMCSA, the US DOT, state licensing authorities, and law enforcement, where we are required to report or produce records.
- Professional advisers — lawyers and accountants, where necessary.
- A buyer — if the business is ever sold or reorganised, personal information may transfer as part of it. Lemberg has had the same owner since 2012 and none of this is planned.
7. Cookies and advertising
This site uses cookies and similar technologies for three purposes:
- Necessary — making pages load and remembering basic preferences. These cannot be switched off.
- Analytics — Google Analytics, to see which pages drivers actually read and where they drop off.
- Advertising and measurement — the Meta Pixel, which tells us when someone who saw a Facebook or Instagram recruiting ad reached this site and clicked through to the application. It also lets us show ads to people who look like the drivers who already applied, and stop showing ads to people who already did.
These tools set their own cookies and receive a limited set of data — typically the page URL, an IP address, a browser identifier and the fact that a button was clicked. They act as independent controllers of that data under their own policies: Meta Privacy Policy and Google Privacy Policy.
You can control this yourself:
- Block or delete cookies in your browser settings.
- Turn off personalised ads in your Facebook ad settings and Google ad settings.
- Use the industry opt-outs at optout.aboutads.info or optout.networkadvertising.org.
- Install the Google Analytics opt-out add-on.
We honour Global Privacy Control signals sent by your browser where we are able to detect them. Blocking analytics or advertising cookies does not affect your application in any way.
8. How long we keep it
| Record | Kept for |
|---|---|
| Driver qualification file of a hired driver | The length of employment, plus three years afterwards, as required by 49 CFR 391.51 |
| Drug and alcohol testing records | One to five years depending on the record type, as required by 49 CFR Part 382 |
| Application from someone we did not hire | Generally up to three years, so we can reconsider you and so we can show our hiring decisions were lawful |
| Call, text and email correspondence | As long as needed to handle your enquiry, then in our normal business records |
| Website analytics data | Per the retention setting in the tool, typically 14 months for Google Analytics |
When a record is no longer needed and we are not required to keep it, we delete it or strip it of anything that identifies you.
9. Your choices and rights
Whatever state you live in, you can ask us to:
- Tell you what we hold about you and where we got it.
- Correct anything that is wrong.
- Delete what we are not legally required to keep. Records the FMCSA or DOT requires us to retain we cannot delete on request — we will tell you plainly which ones those are.
- Stop contacting you.
- Give you a copy of what you provided, in a portable format.
Email [email protected] with "Privacy request" in the subject line, or call 630-592-1235. We will respond within 45 days. We may need to verify your identity first — we are not going to hand a driver's file to whoever asks for it. Exercising any of these rights costs nothing and will never be held against you as an applicant or an employee.
If you live in a state with its own consumer privacy law — California, Colorado, Connecticut, Virginia, Texas and others — you may have additional rights, including the right to opt out of targeted advertising and the right to appeal a refusal. Use the same contact details and tell us which state you are in. We do not sell personal information and we do not process it for profiling that produces legal effects.
10. Security
Access to applicant and driver files is limited to the recruiting, safety and payroll staff who need it. Our website is served over HTTPS, and the application platform we use encrypts data in transit and at rest. Nothing transmitted over the internet is ever completely secure, so we cannot promise absolute security — but if a breach ever affected your personal information, we would notify you and the relevant authorities as the law requires.
Please do not send a Social Security number, a photo of your licence or a medical card to us by plain email. Put them in the application, or ask a recruiter for a secure way to send them.
11. Age
This site and our positions are for adults. Interstate CDL driving requires you to be at least 21 under federal rules, and our own hiring standard is higher than that. We do not knowingly collect information from anyone under 18. If we learn that we have, we delete it.
12. Changes to this policy
If we change how we handle personal information, we will update this page and move the "last updated" date at the top. If a change is significant we will say so plainly rather than quietly editing a sentence. The version on this page is always the current one.
